A 43-year-old autistic North York man and his family are seeking $9 million dollars in damages, more than two years after George Lochner was hit multiple times by a police Taser in his bedroom. Several police officers and the Toronto Police Services Board are named in the lawsuit.

Lawyer Clayton Ruby says police thought Lochner was his brother, Silvano, who was wanted for allegedly threatening to assault his neighbour with a sledgehammer.

Lochner claims six police officers came into his bedroom when he was sleeping.
 

"They pushed me to the wall and I fell down," Lochner said. "They Tasred me on my hand and they punched me in the stomach two times. They grabbed me and put me on the bed. They held my hands down and they punched me in the eye."

Lochner says they then used the Taser on him again.

CFRB's Katie Franzios has more.

Ruby says he can understand why police could feel threatened by the tall, heavy-set man but says Lochner wasn't armed and is harmless. The lawyer says his client was assaulted under a warrant that wasn't signed by the right authorities, therefore making it unusable.

Ruby criticizes the use of tasers by police and says it needs to be stopped.

Mark Pugash, Toronto Police Director of Public Information, says the force is standing by the officers and says they did what they thought was best under the circumstances.
